Accessibility is mandatory: what the BFSG requires of your website

Since 28 June 2025, the Accessibility Strengthening Act (BFSG) has applied in Germany. It implements the European Accessibility Act and mainly affects online shops and digital services for consumers. Find out here whether your company is affected and what exactly needs to be done.

Choose a view and then switch to “accessible”. You will immediately see what the implementation means for real people.

Who is affected

The law applies to products and services offered to consumers after the deadline. For websites, electronic commerce is the decisive factor: everything that consumers can complete online.

  • Online shops that sell to private customers.
  • Booking, appointment and ordering processes on websites and in apps.
  • Online banking, payment services and consumer credit.
  • Passenger transport, such as ticket purchases and timetable information.
  • E-books and telecommunications services.

Purely B2B offers

If an offer is aimed exclusively at businesses, it generally does not fall under the BFSG. Mixed offers for private and business customers, however, are affected.

Exception for micro-enterprises

Service providers with fewer than ten employees and an annual turnover or balance sheet total of no more than two million euros are exempt from the requirements for services. This exception does not apply to products.

Be careful with self-assessment

Both thresholds refer to the company as a whole. Anyone just above them or growing should plan early, because implementation takes time.

What exactly is required

The benchmark is the European standard EN 301 549, which for websites is based on the Web Content Accessibility Guidelines (WCAG) 2.1 at level AA. Content must be perceivable, operable, understandable and robust.

  • All functions can be reached with the keyboard, including the shopping cart and checkout.
  • Images and controls have meaningful text alternatives.
  • Texts have sufficient contrast and can be enlarged without anything being cut off.
  • Forms have visible labels and understandable error messages.
  • Screen readers can correctly read out structure, headings and navigation.
  • An accessibility statement describes how the offer meets the requirements.

What happens in the event of violations

Compliance is monitored by the market surveillance authorities of the federal states. They can order improvements and, in the case of serious violations, prohibit sales. The law provides for fines of up to 100,000 euros.

In addition, there is an often underestimated risk: associations can assert violations, and competitors can issue legal warnings.

Accessibility is mandatory: what the BFSG requires of your website

How to proceed

  • Check whether your offer targets consumers and falls under the BFSG.
  • Take stock with automated tests and a manual review.
  • Fix critical paths first: Navigation, forms, checkout.
  • Create an accessibility statement and publish it on the website.
  • Check new content and updates in future so that the site remains accessible permanently.

Overlay tools are not enough

Tools that display an accessibility toolbar via a script do not fix the causes in the code. They are no substitute for a real implementation.
